員工終止僱傭合約是會得到什麼款項?僱主該何時支款解僱補償?
終止僱傭金解僱解僱補償

解僱員工後,僱主應儘快向員工支付終止僱傭金。

僱主在終止僱傭合約或固定期限的僱傭合約到期時,應支付解僱補償,而這包括:

  • 任何未發放的工資;
  • 代通知金(如適用);
  • 工資代替任何未發放的年假,及該假期年按比例的年假薪酬;
  • 任何未發放的年終酬金,及該酬金期內按比例的年終酬金;
  • 長期服務金或遣散費(如適用);
  • 其他僱傭合約內列明的款項,例如年積金或公積金等。

何時支付終止僱傭金

僱主應儘快向僱員支付所有解僱款項,並可能需要考慮是否應支付遣散費或長期服務費。

若僱主在僱傭合約終止七日內,沒有向僱員發放解僱款項,就要連利息支付所有拖欠的款項。

僱主如故意或無合理理由下拖欠或不向僱員發放解僱付款,將可被處罰款$350,000及監禁3年。
